Terms of Service

This "Terms of Service" provides primary and important terms and conditions in a summary view. Following terms and conditions applies to all products and services offered by Charly Computers.

Warranty & Product Life

All products supplied by Charly Computers are covered under one year of warranty from the date of software installation, unless stated or informed otherwise in a formal document provided by Charly Computers. Warranty only covers known, consistant defects or recreatable runtime bugs/errors in the software. Free updates for the software shall be provided for these mentioned aspects under the warranty period as and when required.

Average life span of products is around 4 to 5 years. Exact duration of time varies from product to product and can be provided on request from Charly Computers or its associated affiliates. Charly Computers will keep the product active and maintain it to provide updates, upgrades and addons during its life span. After the end of product's life, it shall be discontinued from active development and the customer can continue to use the final version for as long as required in "as-is" form.

Prerequisites & Maintenance

Any hardware/software prerequisites required by products offered by Charly Computers shall have to be provided by the customet prior to installation of the software. Charly Computers or it's associates would inform/guide about the prerequisites required based on each product.

Guidelines and support will be provided for product and database maintenance like software reinstall, configure, master data management and data backup & restore for customers under Warranty or AMC. However we shall not be responsible for any day-to-day activities for program/database maintenance or for any data corruption/loss/problems etc. due to any reasons like hardware/network/OS failure, virus/hacking/ransomware attacks, etc.

Cancellation Policy

In case of order cancellation (before the final issue of license) due to any reason, advance amount, if any, will be refunded after deducting non-refundable charge @35% of order value and any additional expenses incurred during that period. Customer shall be liable to pay the mentioned charges if advance amount is less than the deduction amount or in case of nil advance payment.

Refund Policy

We strive to provide our customers with the software of the highest quality along with the best technical, sales and information support services. To help ensure that our software products are just what you need, free trial/demo versions are available for download from our website or from our sales team. Comprehensive products and its features information is also provided during the software demostration.

Since all of our products are sold with lifetime license validity and not as subscription based "Software As A Service" (SaaS), the final license once released, will be active for lifetime. All our products are intangible irrevocable goods (digital software) and hence the refund shall be applicable only under following conditions:

• We are sure the product is malfunctioning consistently (i.e. doesn’t function according to the features declared in official product documents) on the client’s computer and we have not provided a solution to it within considerable time span.
• Product is licensed by a hardware dongle/lock and customer is ready to return the same immediately.
• Claim for refund is made within 10 days of license purchase.
• Amount to be refunded wether in full or partial will be decided on per case basis, based on the expenses incurred for the product development/implementation by Charly Computers and sales/support personnels.

Except for the above mentioned criteria, all other cases shall be ineligible for the refund. The buyers are encouraged and advised to use "Try before you buy" policy for 30-day free trial period before purchasing the product.

Liability

All products are provided as a standard ready-to-use, tried and tested software packages. Charly Computers & its associates will make every effort to deliver high quality error free products but do not guarantee that our products would be free from all defects. Our software will be provided on “as is” basis and you would use the software at your own risk. We make no warranties as to performance, merchantability, fitness for a particular purpose, or any other warranties whether expressed or implied. No oral or written communication from or information provided by Charly Computers or its associates shall create a warranty. Under no circumstances shall Charly Computers or its associates be liable for direct, indirect, special, incidental, or consequential damages resulting from the use, misuse, or inability to use the software, even if Charly Computers or its associates has been advised of the possibility of such damages. Subject to Ahmedabad, India jurisdiction.

Changes to this Terms of Service

Charly Computers has the discretion to update this terms of service at any time. When we do, we will revise the updated date at the bottom of this page. We encourage customers & users to frequently check this page for any changes to stay informed about latest policy. You acknowledge and agree that it is your responsibility to review this terms of service policy periodically and become aware of modifications.

By using this Site and products offered by Charly Computers, you signify your acceptance of this policy. Your continued use of the Site and the products following the posting of changes to this policy will be deemed your acceptance of those changes.
